    The Limits of Intellectual Property Enforcement at the Border

    This paper describes the detention of generic medicines in transit, primarily in the EU, and the implications this has on free trade and access to medicine. Developed countries’ efforts to strengthen intellectual property enforcement and fight against ‘counterfeits’ can contradict the principles of the WTO legal regime and create barriers to legitimate trade.

  • Maintaining Policy Space for Development

    This paper looks at the technical assistance concerns raised by Free Trade Agreements (FTAs) and the challenges to developing countries in regard to implementation. The focus is on FTAs between Latin America and the United States. The primary beneficiaries of TRIPS and TRIPS-plus obligations are industrialized countries, with the costs borne by those in poorer countries. TRIPS and TRIPS-plus arrangements should promote competition through the acquisition and local development of technology.

  • IP Rights under Investment Agreements:

    The Trips-Plus Implications for Enforcement and Protection of Public Interest

    This research paper analyses the impact of investment agreements on the rights and obligations under the Agreement on Trade-Related Intellectual Property Rights. The goal is to reimagine the interplay between intellectual property in North-South investment agreements and the connection with implementing socio-economic and technological development policies. The paper concludes that investment agreements have important implications on intellectual property rights, regulations protecting the public interest, encouragement of technology development and transfers, and competition policies.
